Terms & Conditions KB Adventure
Provided by KB Adventure
- General
a) The information provided to me directly by the representative/s of KB Adventures and/or as contained on the website ( https://kbtourstravel.com/ ) is intended to be a fair representation of prevailing conditions and circumstances while, at the same time, intending to convey a required level of flexibility and adaptability by both parties to these terms. b) The tour price for the main and any additional (supplementary) program/s will have been mutually agreed to by all parties prior to the commencement of the services to be provided.
2. Payment:
The balance (full payment) of the cost of the services has to be paid by the client prior to the departure date of the first service to be provided.
- Price Guarantee:
The price of services agreed is guaranteed.
- Cancellation / Curtailment /Postponement:
a) The deposit is non-refundable, except owing to cancellation by KB Adventures, in which case the deposit will be refunded in b) In the event of cancellation by KB Adventures, only the full amount already paid will be refunded. c) In the event of cancellation by the client/s no refund of the paid deposit will be given. d) In the event of postponement by a client/s once the deposit has been paid, 50% of the deposit paid can be recollected within a 12-month period from the date of the postponement notice. In this case the original price of service is subject to review. e) If at any time prior to the agreed date of commencement of services, the client/s wishes to change or modify the originally agreed upon program, the altered services/dates/prices can be adjusted (upwards or downwards) without penalty, subject to the feasibility and availability of the preferred replacement program. f) Once the contracted program has begun, no refund will be given. In such a case, the client/s’ recourse is to his/her/their insurer. Any consideration by KB Adventures will be made only by a director of Freedom Adventures, and only under very special circumstances.
5. Legal Compliance:
The client/s agrees to comply with all applicable legislation, visas, immigration-, customs and foreign exchange regulations. Should there be any contravention by the client/s of the laws of Peru, KB Adventures has the right to cancel the tour/program without recourse to refund.
- Travel Insurance & Emergency Details:
As strongly recommended by KB Adventures, the client/s agrees to obtain what they consider to be adequate Travel Insurance to cover their person and their personal effects for the duration of the tour(s). The client/s must be satisfied that this insurance will fully meet personal expectations and requirements. a) A photocopy of the client/s’ travel insurance has to be provided to KB Adventures by the client/s. b) The client/s’ emergency contact (i.e., next of kin) also has to be provided.
- Dispute/ Claim Resolution:
In the event of a claim against KB Adventures by the client/s, the cause as well as the extent of the claim must be brought to the attention of Freedom Adventures’ management at the first possible opportunity. Should it be a claim for compensation, it is preferred that any settlement is agreed upon while the client/s remains in Peru, and every effort is to be made to this end. In the event of issues which
cannot to be settled within this timeframe, both parties should at least agree on a resolution process going forward, with the terms and criteria of settlement recorded. As a last resort, all unresolved issues are subject and referred to the applicable Nepalese Law.
- Booking Agreement
A booking is confirmed, and these Terms and Conditions shall apply when KB Adventures have received the applicable deposit from the client and the client has received written confirmation from KB Adventures of such booking. The client confirming the booking must be 18 years of age and above and agrees to provide full, complete and accurate information as requested KB Adventures to confirm the booking. Any client confirming a booking on any tours with more than one client named and booked on such booking represents and warrants to KB Adventures that:
- They have all requisite consents and authority to make such a booking on behalf of all other clients named on the booking and have communicated all necessary information to the other clients in order for them to give free and fully informed authorization to do The information that they have provided regarding all clients is complete and accurate, and they have obtained all necessary consents and permissions to share such information with KB Adventures for the purposes of completing the booking.
- Contractual Commitment:
Both the client/s and KB Adventures agree that once the deposit has been paid, the above terms and conditions will be binding to both parties, and that the Client/s’ Assumption of Risk and Guarantee will be honored.
- Client/s Assumption of Risk and Guarantee:
The client/s is aware that the mountain trek or expedition, whitewater rafting trip, jungle tour or any other journey or vacation under the arrangements of KB Adventures Pvt. Ltd and its subsidiaries, associates or agents, involves certain risks and dangers which may be exceptional compared with the client/s everyday norms, these include but are not limited to: 1) Travelling in mountainous terrain, on rivers and in the forest and jungle. 2) Travelling by aircraft, car, coach, jeep, boat, raft, elephant, donkey, bicycle, or any other means of conveyance. 3) Accidents or illness in remote regions with little or no medical facilities and/or without means of speedy communication and/or evacuation. 4) Accidents caused by the forces of nature.
- Complaints
Client agrees to bring any complaints regarding a tour to KB Adventures as soon as possible in order to provide KB Adventures with the opportunity to address such complaint properly. Client agrees to inform the head guide or other designated KB Adventures representative at the earliest opportunity. KB Adventures assumes no liability for complaints that are not properly brought to the attention of KB Adventures with sufficient notice for KB Adventures to resolve or attempt to resolve any client complaints. Any complaint made after the completion of a tour must be received in writing by KB Adventures within 30 days of the end of the tour in question.
- Medical Conditions
All clients are obligated to truthfully provide requested relevant medical information to KB Adventures upon booking their tour. Clients are responsible for assessing their own suitability and capability to participate a tour with us. All clients should consult their physician regarding their fitness for taking part in the booked tour. KB Adventures recommends all clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns
regarding the entirety of the client’s travel with KB Adventures. KB Adventures
does not provide medical advice.
Adventure tours provided by KB Adventures involve visiting remote or less developed regions
of Peru, where medical facilities may not meet the standards of those found in a client’s home
- Changes in itinerary due to reasons beyond the control of KB Adventures.
In consideration of the above, and as part of the payment for the right to participate in such treks, tours, rafting trips or other activities and the services arranged by the aforementioned company and its subsidiaries, associates, agents and employees, I/We have and hereby assume all the above risks and will hold KB Adventures blameless, and will defend them against any and all liability actions, causes of actions, suits, debts, demands and claims of every kind and nature whatsoever, which may hereafter arise out of or in connection with the trip or participation in activities arranged by the aforementioned company and its subsidiaries, associates and agents. This agreement shall serve as a release and as my stated assumption of risk and as guarantee by myself on behalf of myself and my heirs, administrators, executors and all members of my family including any minors whether accompanying me or not.
- Payment Terms Payment
A deposit is required to secure the booking. Final balance is due two months before the trip start date. Payment must be made within 7 days of the final balance due date. Failure to make payment will result in cancellation of your trip
- Cancellations
You can cancel bookings on these terms, and will be refunded accordingly:
- Two months or more before departure: we refund 100% of holiday cost, less any deposit
- Two months or less before departure: we refund 0% of holiday
